Sometimes perpetrators of violence make threats that the other person won’t be entitled to a share of the family home and property.
If you have to leave the family home you will not lose the right to your share of the home or other property.
In limited circumstances you may be able to get a Sole Use and Occupation Order from the Family Court which orders your former partner to leave the family home. The court looks at the needs and resources of both parties when deciding who should stay in the house.
You should seek legal advice if you are considering making an application for any orders.
